Moosalp mountain railroads AG

1 General

The General Terms and Conditions (GTC) apply to all services and products of Moosalp Bergbahnen AG (MBB). When using certain services, additional special provisions may apply.

 

2 Covid 19 - certificate requirement, if any

A possible introduction of the certificate obligation for ski areas by the federal government applies to the entire ski area of the Moosalpregion. Non-use of the (transport) facilities does not entitle the holder to exchange, change, transfer, refund in whole or in part, nor to take back purchased tickets/ski passes. Closure or partial closure of the facility is expressly reserved and does not give rise to any claims, just as in the case of service interruptions.

 

3 Tickets and season tickets

3.1 Validity

Tickets and season tickets are personal (except for points cards) and non-transferable. They are only valid during the published operating hours. All journeys outside the official operating times are not included in the ski pass, etc..

3.2 Magic Pass

The Moosalp Bahnen is a partner of the Magic Pass (Magic Mountains Cooperation, Société Coopérative) from 01.05.2023. Any claims and refunds for owners of a Magic Pass must be filed directly with the Magic Mountains Cooperation. Separate contract conditions for the Magic Pass (Magic Mountains Cooperation) apply. 3.3 Discounted tickets / family and group discounts / IV card

  • For the purchase of discounted tickets, official identification documents indicating the date of birth are required, which must be presented without being asked. Without presentation of the relevant identification, no tariffs deviating from the normal tariff will be granted. The age groups defined by Moosalp Bergbahnen AG before the season are decisive.
  • A family discount is granted if a family obtains three or more ski passes at the same time upon presentation of an ID card. Families are one or both parents together with their own children up to the age of 16 (tariff category child).
  • A group discount is granted for clubs, schools or companies with 10 or more people and only upon advance reservation. An association of several families is not considered a group.
  • Disabled adults with the appropriate IV card are granted the ski pass at the children's rate. Children with disabilities and the corresponding ID card ski free of charge. Accompanying persons of disabled children ski for free.
  • No discounts are given on infant tickets.

3.4 Scorecards

Point cards are transferable to persons in the same fare class and are valid for 2 years. If a point card has expired, the following penalty points will be deducted:

1-30 days exceeded: 10% penalty points | 31 days-1 year: 20% | More than 1 year: 50%

On presentation of a medical certificate of 3 months and more, the points card will be extended for 2 years without penalty points.

3.5 Data carrier

If tickets are issued as keycards, a deposit fee of CHF 10.00 will be charged. The deposit will be refunded when the card is returned. Damaged tickets will not be refunded.

3.6 Loss or theft

Half-day, day and unpersonalized multi-day passes (up to 3 days) will not be replaced in case of loss or theft. In case of loss or theft of a season pass or a personalized multi-day pass of 4 days or more, the ski pass will be replaced once upon presentation of the blocking receipt. A handling fee of CHF 10.00 (plus deposit) will be charged for the issuance of the replacement card.

3.7 Exchange / Refund

  • Purchased tickets and season tickets will not be exchanged, changed or returned.
  • Money return must be checked immediately after the ticket is issued. Later complaints can unfortunately no longer be considered.
  • Every customer who buys a multi-day pass or ski season subscription can take out an insurance policy at the ticket office or in the online store. This allows a refund in case of illness, accident and lift closure due to adverse weather conditions, such as storm, avalanche danger, etc., if at least 50% of the ski area is closed, within the general terms and conditions of EuropAssistance.

No refund will be given without insurance.

  • If Moosalp Bergbahnen AG can only partially or not at all fulfill its obligations arising from the transport contract due to circumstances which it is unable to avert, the purchaser of a ski pass shall not be entitled to any reduction or reimbursement of costs.

This applies in particular in the following cases:

  • Suspension of operations and closures for safety reasons and as a result of force majeure such as poor snow and weather conditions, avalanche danger or official orders
  • Operating restrictions and partial discontinuation of transport facilities due to seasonal or reduced rail operations
  • Overload of the transport systems
  • Operational malfunctions, e.g. as a result of technical defects or power interruptions
  • Official orders or restrictions (among other things, as a result of power shortages)
  • Voluntary restrictions due to special circumstances (among other things, as a result of austerity measures taken by the authorities due to a power shortage)
  • Pandemic or epidemic

3.8 Control / Abuse / Forgery

In the ski area, checks of ski passes or tickets can be made at any time by the employees of Moosalp Bergbahnen AG. Misused or forged tickets and passes will be confiscated. Tickets and passes that are in use and not suitable for use can be withdrawn under application of the same provision. A handling fee of CHF 200.00 is payable.

Civil or criminal measures remain reserved.

3.9 Ticket control

There is an electronic issuing and control system for tickets. The readers must be used properly and the skier must follow the instructions of the staff. The ski pass must be presented upon request.

3.10 Euro rate

If payment is made in EURO, the exchange rate defined by Moosalp Bergbahnen AG on the basis of the economic situation applies.

 

4 Means of payment

Moosalp Bergbahnen AG accepts the following means of payment:

  • Cash (CHF or EURO)
  • All major credit cards
  • Postcard
  • REKA and REKA Card

 

5 Exclusion from transport

5.1 General

Persons may be excluded from the transport if they:

  • are drunk or under the influence of narcotics
  • misbehave
  • do not follow the rules of use and conduct or the instructions of the staff based on them.

5.2 Transportation for the practice of a sport

If the weather conditions are unsuitable for the practice of the sport, in particular in case of avalanche danger, persons can be excluded from the transport for the practice of the sport. Furthermore, persons may be excluded from transport for the practice of a sport if they endanger third parties immediately before the intended transport and there is reason to believe that they will continue to endanger third parties. In case of repetition or in serious cases, the ticket can be withdrawn.

A risk to third parties exists in particular if the person concerned:

  • has behaved recklessly
  • has driven on an avalanche-prone slope
  • has disregarded instruction and prohibition boards that serve to ensure safety
  • has defied the safety orders of the supervisory and rescue services

 

6 Liability

As far as permissible, the liability of the cableway company is limited to gross negligence and intentional conduct.

 

7 Safety on the slope / Rescue service

7.1 General

The FIS rules of conduct and SKUS guidelines must be observed. Each skier skis at his own responsibility. The marked slopes are not to be left under any circumstances. Forest and game protection zones are to be avoided. Adhere to the general valid regulations. Outside the lift operating hours and after the final check, pistes and runs are closed and not protected from any hazards such as avalanche blasting or piste machines (with winches). Skiing on or walking on the slopes after the slopes have closed is prohibited for safety reasons.

7.2 Rescue service

If the customer has an accident on the territory of Moosalp Bergbahnen AG and therefore the rescue service has to be called, the customer will be charged a maximum amount of CHF 270 plus material costs. Third party costs (e.g. Air Zermatt, doctor) will be paid directly by the customer. Any claims for reimbursement must be made by the customer to his insurance company.

 

8 Data protection

The collection and processing of customers' personal data by Moosalp Bergbahnen is explained in the privacy policy at www.moosalpregion.ch. This forms an integral part of the contract of the GTC.

 

9 Applicable law / place of jurisdiction

The contract between the customer and Moosalp Bergbahnen AG is subject to Swiss law. The place of jurisdiction is Leuk, unless mandatory legal provisions stipulate a different place of jurisdiction.
